A row is brewing over the circumstances under which the Ministry of Infrastructure Development directed the Tanzania Ports Authority (TPA) to pay millions of shillings to a UK-based consultancy firm for services it rendered to third parties. The British firm, DLA Piper, was paid for services it had rendered to the Tanzania Airports Authority, which -although also falling under the ministry - is a totally different entity. DLA Piper was asked to carry out a consultancy at the Tanzania Ports Authority (TPA) on two worn-out Single Buoy Mooring (SBM) and Single Point Mooring (SPM) systems at the Dar es Salaam port as well as a consultancy on construction works at the Kilimanjaro and Mwanza airports for the Tanzania Airports Authority (TAA). TAA and TPA both fall under the Ministry of Infrastructure Development. But it is the TPA that was asked to pay for consultancy services towards not only the revival of the SBM and SPM but also the two airports plus another assignment for the Kilimanjaro Airport Development Company Ltd (Kadco). The EastAfrican has learnt that former infrastructure development minister Andrew Chenge - who was recently forced to resign over alleged improper payment in the Watchman radar scandal - is alleged to have asked the TPA to pay for the services rendered for the two airports and Kadco despite the fact that the cost was to be incurred by the TAA. The Ministry of Infrastructure Development directed the TPA to pay DLA Piper $398,322.60 for the consultancy services, although it had already paid $62,956.62 for the consultancy on the SBM and SPM at Dar port. The TPA management initially paid the $62,956.62 in September last year as consultancy fees for services rendered for airports at Mwanza and Kilimanjaro, and the SPM oil-offloading facility at the port. However, it refused to pay the remainder of the money and instead asked the ministry to explain why it was being made to pay for services that were rendered in connection with the two airports, "which had nothing to do with Tanzania Ports Authority and its activities." TPA Director General Ephraim N. Mgawe, in Memo No 5/2008S addressed to the TPA board of directors, said that the authority received the request from the ministry via letter No CMC 13/141/02/Vol.IX/5 of April 9 to pay the $398,322.60 balance owed to DLA Piper. This firm [DLA Piper] was asked by the ministry to provide consultancy on the way forward as regards policy and other legal matters linked with involving the private sector. Besides, the UK firm was also advising the ministry on projects on expansion and construction of airports together with the SPM project at Dar es Salaam port," said Mr Mgawe. According to the TPA, it was neither involved in negotiating the contract with DLA Piper nor was it party to the agreement signed between the parent ministry and the law firm. "The Tanzania Ports Authority wasn't involved in entering the contract with the UK firm. In addition, the Authority wasn't furnished with procedures that were used to employ the consultant and whether the procurement law (PP Act 2004) was followed," said Mr Mgawe. In view of the fact that the beneficiary of the consultancy was the Tanzania Airports Authority, the TPA advised that the request to pay the consultant be directed to TAA. "We don't have any funds that were set aside for such an undertaking as we have a host of other projects that need our attention," said Mr Mgawe. A breakdown of the payments indicates that there were four bills to be settled for consultancy work on Kilimanjaro Airport, while one was for Mwanza Airport. The total for Kilimanjaro Airport was $320,925.41 and that for Mwanza Airport was $77,397.20. The immediate former permanent secretary at the Infrastructure Ministry, Dr Enos Bukuku, who is now one of the three Deputy Governors of the Bank of Tanzania, wrote to the UK firm saying he had directed the TPA to pay them. "I have asked M/S Tanzania Ports Authority to pay your bills on behalf of the Ministry of Infrastructure Development for consultancy work that you have done for the Ministry on Mwanza Airport, SBM, KIA/Kadco and others," said Dr Bukuku in the letter to DLA Piper. Charles Morrison represented DLA Piper, one of the biggest law firms in the UK, in the consultancy. Contacted for comment, the chairman of the TPA board, Raphael Mollel, told The EastAfrican that they had written back to the ministry, indicating that they were not in a position to pay the $398,322.60 that the ministry had asked them to settle. "We told the parent ministry that we couldn't afford to pay the almost Tsh400 million because it wasn't budgeted for and the $62,956.62 we paid was also not our debt," he said. He added that he was not in a position to say whether it was right or wrong for the ministry to instruct TPA to pay for services that were rendered to the Airports Authority. "The two institutions fall under the same ministry and it was the minister's decision to instruct us to pay the debt but, like I said, we weren't in a position to pay," said Mr Mollel. Makala Nakala chapishi   Mtumie mwenzio  Jiandikishe utaarifiwe   Taarifa ya Lowassa kuchunguzwa balaa Mwandishi Wetu Disemba 1, 2010 Raia Mwema lapata msukosuko Nakala 10,000 zaharibiwa zisisomwe HABARI iliyoihusisha familia ya Waziri Mkuu aliyejiuzulu, Edward Lowassa, imeibua utata mkubwa baada ya kuibuka kwa vitisho vilivyosababisha kuzuiwa kuchapwa kwa gazeti la Raia Mwema toleo lililopita Namba 161 katika mazingira ya kutatanisha; huku habari hiyo ikikanushwa kwenye gazeti jingine hata kabla haijatoka. Utata huo ulisababisha uongozi wa Imprint iliyopo chini ya kampuni ya Jamana Printers kusitisha ghafla kuendelea kuchapwa kwa gazeti la Raia Mwema ikiwa tayari limeshachapwa nakala 10,000 katika mazingira yaliyoonyesha kuwapo shinikizo zito kutoka kwa kigogo mmoja aliye karibu na mwanasiasa huyo la kutaka habari inayomhusu Lowassa iondolewe ndipo gazeti lichapwe. Raia Mwema  ambalo lina makubaliano maalumu na wachapaji hao lilishtushwa na uamuzi huo wa ghafla wa wachapaji hao hasa baada ya uamuzi huo kuambatana na hali ya woga mkubwa uliotawala wafanyakazi wa kiwanda hicho usiku wa Jumanne ya wiki iliyopita. Taarifa ya Meneja Usambazaji wa Raia Mwema, Omari Mwendapole, ambaye alikuwapo usiku huo, inaeleza kwamba hali ya uchapaji iliendelea katika hali ya kawaida kuanzia saa 11 jioni kabla ya kubadilika ghafla saa 1:30 usiku, ilipotolewa amri ya kusitisha uchapaji wakati zikiwa zimekwishachapwa nakala 10,000. “Tulifika kiwandani mapema saa 11:00 na hakukua tatizo lolote baada ya wahusika kukagua gazeti letu na kuridhika nalo na wakaanza taratibu zote ikiwa ni pamoja na kuchoma plate saa 11:15 na saa 12:00 kazi ya uchapaji ilianza taratibu hadi saa 12:30 mashine zilipoanza kuchanganya na kutoa gazeti zuri. “Lakini baada ya muda kidogo,  msimamizi wa uchapaji wa Imprint akaitwa na mlinzi kwenda kusikiliza simu na aliporejea akawaagiza mafundi wazime mashine kabla ya kuamua kuzima mwenyewe baada ya kuona wanachelewa kufanya hivyo. “Baadaye niliitwa kwa bosi wao na kuambiwa natakiwa kwenda kwa Meneja Mkuu, aitwaye Shaber, ambako nilijulishwa kwamba ni lazima habari kuu (inayomhusu Lowassa) iondolewe vinginevyo gazeti halitochapwa kabisa,” anasema Mwendapole. Kutokana na amri hiyo ya wachapaji, wafanyakazi wote wa Raia Mwema na watu wengine wote waliokuwamo kiwandani wakati huo waliamriwa kutoka eneo la uchapaji na kupekuliwa kuhakikisha hawabebi hata nakala moja ya gazeti hilo. Habari zinasema kuwa nakala 10,000 ambazo tayari zilishachapwa ziliharibiwa chini ya uangalizi mkali wa maofisa wa kiwanda hicho ili kuhakikisha kuwa haziingii kwenye soko, na hivyo habari hiyo kusomwa na wananchi. Hata hivyo, wakati uongozi wa Raia Mwema ukihangaika kutafuta mahali pengine pa kuchapa, ilibainika kwamba kigogo huyo pamoja na mbunge mmoja walikuwa tayari na nakala ya gazeti hilo na ilidhihirika siku iliyofuata baada ya gazeti la Mtanzania lenye uhusiano wa karibu na kigogo huyo kuchapisha habari iliyokanusha habari hizo kabla hata ya habari husika kuchapishwa. Katika habari hiyo, gazeti hilo lilielezea kwamba kuna taarifa “zilizochapwa katika magazeti” huku zikimnukuu Frederick Lowassa,  ambaye ndiye aliyekuwa mhusika mkuu katika habari ya Raia Mwema, akijitetea kwa kudai kwamba hakuwahi kusafirisha fedha nyingine Uingereza kama ilivyoandikwa na ‘magazeti hayo.’ Katika tukio hilo la aina yake katika tasnia ya habari, Frederick Lowassa, alisema; “Jamani mimi nashangaa sana. Watu hawa wanasahau kuwa mimi ni mfanyabiashara kwa zaidi ya miaka kumi sasa. Na katika kufanya biashara ni lazima nisafirishe fedha nje ya nchi kwa nia ya kununua material (bidhaa). Nasafirisha fedha sehemu mbalimbali duniani, na sijui wameliokota wapi hilo. “Hakuna wakati nimewahi kusafirisha paundi 495,000 nje ya nchi kwa mara moja, ila nasafirisha fedha nje ya nchi kununua bidhaa mara nyingi tu. Hili wanalozungumza la Uingereza ni kweli kati ya Machi na Aprili nilisafirisha kama Paundi chini ya 200,000 hivi, kwa ajili ya biashara kama kawaida. Benki kama kawaida walijiridhisha fedha hizo zilikotoka, tukawasiliana  likaisha. “Sasa nashangaa watu hawa hili wamelitoa wapi? Na ifahamike kuwa mimi nafanya biashara nyingi tu, na moja ya biashara zangu ni kampuni ya Alphatel. Sisi ni mawakala wa Vodacom. Tunover (mzunguko wa fedha) yetu kwa mwezi ni zaidi ya Sh bilioni 8.0. Hizi ni fedha zinazotumiwa kama sehemu ya mtaji na faida kwa kununua bidhaa na kuuza. Sasa walitarajia mfanyabiashara kama mimi nishindwe kutumia kiasi hicho nje ya nchi? Nanunua vitu kutoka Uingereza, China, Falme za Kiarabu (Dubai), Afrika Kusini, Italia na sehemu nyingine. Watu wa ajabu kweli hawa. “Nasikitika jinsi wanavyoendelea kumchafua mzee wangu. Na ndio maana  nimeelewa barua hiyo ya mwaka jana imeletwa leo wiki hii. Tayari nimewasiliana na mwanasheria wangu katika hili na nitatoa vielelezo vyote, hakuna cha kuficha…. Jamani siasa zao wazibakize huko, kazi waliyofanya kumchafua mzee wangu (Lowassa) hawajaridhika kweli? Katika hili nasema hapana.” Habari hiyo ilifuatiwa na habari nyingine ambayo iliyomnukuu Lowassa mwenyewe akionyesha kwamba Lowassa anaandamwa na katika toleo hilo aligusia tena kuhusu mwanae Fredrick kuchukua hatua za kisheria kuhuhusiana na habari inayohusiana na usafirishaji fedha Uingereza. Habari hiyo imenukuliwa tena katika gazeti lingine jana. Uongozi wa Raia Mwema tayari umeiandikia barua kampuni hiyo ya uchapaji ukilalamikia tukio hilo la kuzuia gazeti lisichapwe na kuharibu nakala  ambazo tayari zilishachapwa, na pia kutoa usiku huo huo baadhi ya nakala za toleo hilo kwa watu wa nje bila idhini ya wamiliki wa gazeti. Pia unataka ulipwe fidia kwa hasara iliyopatikana kwani ililazimu gazeti kuchapwa kwingineko alfajiri, na hivyo kuchelewa kuingia sokoni. Katika habari yake ya wiki iliyopita iliyoibua mambo yote hayo,  Raia Mwema liliripoti  kwamba Frederick Lowassa anachunguzwa na Kitengo Maalumu cha Polisi wa Kimataifa wa Uingereza wanaofuatilia utata wa uhamishaji fedha kutoka Tanzania. Fedha hizo zinahusishwa na ununuzi wa nyumba yenye thamani ya pauni za Uingereza 475,000 (takriban Shilingi bilioni moja) katikati ya Jiji la London. Hata hivyo, watu walio karibu na Frederick wameelezea kwamba kijana huyo hakuwahi kununua nyumba; bali aliwahi kutaka kupanga kwa ajili ya kuishi akiwa masomoni nchini Uingereza na fedha nyingine alizituma kwa ndugu yake aishie nchini humo. Nyumba ambayo inatajwa katika maelezo ya awali iko mtaa wa Leinster Gardens, jijini London. Hata hivyo, hakuna ofisa yeyote wa Serikali ya Tanzania aliyekuwa tayari kuzungumzia suala hilo, pamoja na kuwapo taarifa kwamba tayari vyombo vya dola vya Tanzania vimekwisha kuhusishwa katika uchunguzi huo. Maofisa wa Polisi wa Idara ya Upelelezi wa Jinai (CID) wanaohusika na uchunguzi wa fedha haramu, wamekwepa kuzungumzia suala hilo na Mkurugenzi wa Upelelezi wa Makosa ya Jinai (DCI) Robert Manumba, hakuweza kupatikana, na alielezwa kuwa nje ya nchi kikazi. Ofisa wa CID aliyeelezwa kuongoza kitengo kinachochunguza makosa ya uhalifu wa fedha na nyaraka, Naibu Kamishna wa Polisi (DCP), Samson Kasala, alikanusha kufahamu chochote kuhusiana na suala hilo, kabla ya kukata simu alipohojiwa na Raia Mwema kuhusu taarifa hizo. Taarifa zinaeleza kwamba Kitengo cha Ufuatiliaji wa Fedha Haramu (Financial Intelligence Unit-FIU) kilichopo chini ya Wizara ya Fedha nchini, kilipokea taarifa kutoka Polisi wa Kimataifa wa London, Uingereza, wakitaka taarifa muhimu kuhusiana na Frederick, kabla ya kitengo hicho kuomba msaada wa polisi. Hata hivyo, Kamishna wa FIU, Herman Kessy, hakutoa ushirikiano na Raia Mwema, kuhusiana na sakata hilo. FIU imeanzishwa chini ya Sheria ya Udhibiti wa Fedha Haramu ya mwaka 2006 (Anti-Money Laundering Act-2006) kwa kuundiwa kanuni mwaka 2007, lakini hadi sasa kitengo hicho kimekuwa kikiendeshwa na maofisa watano tu, Kamishna Kessy, mchambuzi mmoja, mtaalamu wa mawasiliano na wasaidizi wawili wasio wataalamu, kitengo kilichopaswa kuendeshwa na watu wengi zaidi kutokana na unyeti wake. Habari zinaeleza kwamba hata ofisa wa Polisi aliyewahi kuhamishiwa FIU kwa kazi maalumu alijikuta akitengwa na kutopangiwa kazi na maofisa hao ambao wengi wanatoka Benki Kuu ya Tanzania (BoT), baada ya kuwa ‘wameaminiwa’ sana na uongozi wa juu wa serikali. Kwa mujibu wa taarifa hizo ambazo bado zinafanyiwa kazi, Frederick ambaye baba yake alijiuzulu Waziri Mkuu kwa kuhusishwa na kashfa ya ununuzi wa mitambo ya kuzalisha umeme iliyokabidhiwa kwa kampuni tata ya Richmond Development LLC, anadaiwa kufanya mawasiliano kupitia kampuni ya uwakala iliyotajwa kwa jina la ‘Mishcon’. Nyaraka alizowasilisha, zilidai kuwapo ubia kati ya mtuhumiwa huyo na kampuni tatu ikiwamo Integrated Property Investment(T) Ltd na Barare Ltd Company. Mkataba huo unaonyesha kuwa Frederick Lowassa ana hisa kwenye kampuni hizo, na kwamba fedha za ununuzi wa nyumba hizo zinatokana na fedha za malipo ya hisa anazopata kutokana na kampuni hizo. Hata hivyo, mkataba huo unaonyesha kusainiwa Machi 25 mwaka 2009 siku moja baada ya Frederick Lowassa kusaini mkataba kati yake na kampuni ya Mishcon kama wakala wake katika ununuzi wa jengo hilo. Pia aliwasilisha nyaraka zinazoihusisha kampuni ya Alphatel kama moja ya kampuni ambayo pia yeye ni mkurugenzi wake ambayo pia ni chanzo chake kingine cha fedha anazotumia kununua jengo hilo. Taarifa zimedokeza kuwa ununuzi huo ulikwama baada ya kushindwa kutoa malipo hayo kwa mujibu wa mkataba kati yake na wakala wa ununuzi wa nyumba hiyo (kampuni ya Mishcon) ambao ulimtaka awe amekamilisha kulipa fedha hizo kabla ya Aprili 14, mwaka 2009. Hata hivyo, siku chache baadaye ndani ya mwezi huo wa Aprili, Frederick aliipelekea Mishcon kiasi cha pauni za Uingereza 199,940 zikitokea kwenye kampuni ya ununuzi fedha ya Wall Street Exchange. Aidha kiasi cha pauni 100,000 kiliingizwa kwenye akaunti ya kampuni hiyo hiyo ya Mishcon kwa fedha taslimu katika mikupuo 12 tofauti zikitokea kwenye matawi tofauti ya benki ya NatWest Bank plc iliyoko Kaskazini mwa Jiji la London. Raia Mwema limeelezwa kuwa mazingira ya kuingizwa fedha hizo kwenye akaunti ya wakala huyo ( Mishcon) ndiyo yameifanya Taasisi ya SCD 6 Economics and Specialist Proceeds of Corruption Unit ya Uingereza inayosimamia uchunguzi wa sakata hilo kuwa na mashaka makubwa kuhusu uhalali wa fedha hizo. Kutokana na mazingira hayo, SCD 6 Economic and Specialist Crime Proceeds of Corruption Unit yenye ofisi zake Victoria Block, New Scotland Yard, London, ililazimika kuwasiliana na FIU ikitaka maelezo ya awali kuwezesha kufanyika kwa uchunguzi kuhusu fedha hizo. Raia Mwema iliwasiliana na Fred ambaye alikana kununua nyumba Uingereza lakini alikiri kuwahi kutuma fedha huko. Aliliambia Raia Mwema pia kwamba hajawahi kuhojiwa na yeyote kuhusu suala hilo, na pia kwamba hana taarifa kuwa polisi wa Uingereza wanampeleleza. Hata hivyo kwa upande mwingine, gazeti hili limebaini kuwa, maelezo ya awali ambayo yalitakiwa kutoka Tanzania na makachero hao wa Uingereza, ni pamoja na kutaka kufahamu kama kweli Frederick Edward Lowassa amezaliwa Agosti 26, 1977,  Mwanza Tanzania na anamiliki hati ya kusafiria yenye namba AB 109402 iliyotolewa Tanzania na kwamba anwani yake nchini Uingereza ni 71 Hendrix Drive, Milton Keynes, MK8 0DY. Pia makachero hao waliitaka Serikali ya Tanzania kutoa ufafanuzi wakitaka kujua kama Frederick Lowassa ni mbia katika kampuni za Alphatel Partnership (Tanzania) Barare Ltd na Intergrated Tanzania Limited, kampuni ambazo zimefahamika kumilikiwa na familia ya Lowassa. Asasi hiyo ya Uingereza pia imeomba kujua kama FIU wana taarifa zozote za uhalifu dhidi ya Frederick Lowassa na kama baba yake Edward Lowassa anachunguzwa kwa tuhuma yoyote ya rushwa na mamlaka za uchunguzi wa rushwa nchini Tanzania kuhusu fedha haramu. Uchunguzi wa awali uliofanywa na vyombo vya dola, ulielezwa na taarifa hizo kwamba Frederick Lowassa si mbia katika kampuni hizo na kwamba Barare Ltd wenye hisa ni  Edward Ngoyai Lowassa mwenye hisa 500 na Regina Mumba Lowassa mwenye hisa 500 huku wakurugenzi  wakiwa ni hao hao. Ofisa wa Uingereza anayesimamia uchunguzi huo, George Simpson, ameliambia Raia Mwema kupitia barua pepe kwamba kanuni za uchunguzi kuhusiana na kesi zenye mguso wa kisiasa huwazuia kukanusha au kuthibitisha kuhusu uchunguzi unaoendelea hadi pale wanapofikia hatua ya kukamata mtuhumiwa ama anapofikishwa mahakamani. Taarifa ambazo gazeti hili limezipata mwanzoni mwa wiki hii kutoka vyanzo vyake zinasema kwamba uchunguzi wa suala hilo bado unaendelea, na kwamba watendaji wamepewa maelekezo ya kuendelea nao.
